GENERAL TERMS OF AGREEMENT School: Shall provide programs of study that meet minimum curriculum requirements as prescribed by the state regulatory agency. May change kit contents, textbooks, dress code, curriculum format, teaching materials or educational methods at its discretion. All programs are taught in English; the contract is in English. Will grant a diploma and official transcript upon successful completion of the program, including passing a final comprehensive written and practical examination, meeting all financial obligations, and completing exit requirements. Issue an Official Transcript of Hours to students who withdraw if exit requirements and payment arrangements are met. Will assist graduates in finding suitable employment by posting area employment opportunities and teaching job readiness classes, but placement is not guaranteed. The school may terminate the student's enrollment for failure to comply with school policies, rules, regulations, or for improper conduct. The Student Agrees To: The student agrees to pay the tuition and fees according to the payment schedule selected. The student agrees to comply with all school rules, policies, standards of conduct, and state and federal regulations. The student agrees to provide all necessary financial aid documentation in a timely manner. The student agrees to abide by the school's dress code and maintain a professional appearance. The student agrees to attend all scheduled classes and clinical sessions. The student understands that he/she must maintain satisfactory academic progress as defined by the school in order to remain eligible for Title IV funds. The student is responsible for any state licensing examination fees. Extra Instruction Fee The Academy will charge additional tuition for hours beyond the contracted end date at the hourly rate of the program. Any additional hours must be paid in advance. Re-Entry Students who withdraw or are terminated and wish to re-enter must reapply for admission, meet current admission requirements, and pay a re-entry fee of $500. Graduation The school will grant a diploma and official transcript of hours upon successful completion of the program, which includes passing a final comprehensive written and practical examination, satisfying all financial obligations to the school, completing all exit paperwork, and attending an exit interview. TERMINATION POLICY The school may terminate the student's enrollment for failure to comply with school policies, rules, regulations, or for improper conduct. The administration termination fee is $150. The student will be automatically suspended and attendance terminated for any of the following reasons: 1. Positive proof of theft on school premises. 2. Drug and/or alcohol use during school hours. 3. Failure to pay tuition as agreed upon. 4. Poor attendance or tardiness. 5. Any action which causes or could cause bodily harm to a client, student, or employee. 6. Failure to comply with school, State and Federal rules and regulations. 7. Immoral or improper conduct. 8. Not performing all clinical services assigned. 9. Classroom conduct. REFUND POLICY This refund policy applies to all terminations for any reason, by either party, including student decision, course or program cancellation, or school closure. A student or legal guardian cancels the contract and demands his/her money back in writing, within three business days of signing the enrollment agreement regardless of whether the student has actually started training. All monies collected by the school are refunded. In the case of a student canceling the contract after three business days of signing, but prior to entering classes, the student is entitled to a refund of all monies paid to the school less an application fee, if applicable, and registration fee. PERCENT OF SCHEDULED TIME ENROLLED TOTAL TUITION SCHOOL SHALL RECEIVE/RETAIN 0.01% to 4.9% 20% 5% to 9.9% 30% 10% to 14.9% 40% 15% to 24.9% 45% 25% to 49.9% 70% 50% and over 100% In the case of disabling illness or injury, death in the student's immediate family or other documented mitigating circumstances, a reasonable and fair refund settlement will be made. If the school permanently closes or cancels the program, a pro-rata refund will be provided. Administrative/cancellation fee: $150.00 for students who withdraw after starting. Other charges the student may have incurred at the institution (kit, books, supplies, equipment, etc.) are non-refundable and must be clearly identified. RETURN OF TITLE IV FUNDS Any monies due the applicant or student shall be refunded within forty-five (45) days of official cancellation or withdrawal. The date of determination of withdrawal is the earlier of the date the student notifies the school or the last date of attendance. For unofficial withdrawals, schools that are required to take attendance must document the withdrawal no later than 14 days after the last date of attendance. If a Title IV recipient withdraws, the school must perform a Return of Title IV (R2T4) calculation. The amount of Title IV aid earned is based on the percentage of the payment period completed. Unearned funds must be returned to the Department in this order: Unsubsidized Direct Loan, Subsidized Direct Loan, Direct PLUS Loan, Pell Grant, other Title IV programs. After the school returns its portion of unearned Title IV funds, the student may owe the school or the Department for any remaining unearned aid.

Academy Acknowledgment

The school will notify students of any changes to policies and will publish school outcome rates (completion, licensure, and placement) in the catalog.

I have been given the opportunity to clarify any information of which I am unsure. 3. I have read and understand all information contained in this Enrollment Agreement, the school catalog, and all attached documents. I understand that this document is a legally binding contract. 4. This Agreement constitutes the entire agreement between the Academy and myself and supersedes all prior understandings or agreements, written or oral. No further modification or representation except as herein expressed in writing will be recognized. 5. I have received a copy of this contract. 6. Any controversy or claim arising out of or relating to this agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Rules of the American Arbitration Association. Judgment upon the award rendered by the Arbitrator may be entered in any court having jurisdiction.

Authorization to Hold Credit Balances

A Federal Student Aid credit balance is created when Title IV funds credited to a student's account exceed the tuition, fees, and other educationally related charges assessed by the school. I authorize Fountain of Youth Academy of Cosmetology to use Title IV, HEA program funds, including Federal Pell Grant and Federal Direct Loan funds, to credit my student account for tuition, books, kits, supplies, and fees. I authorize Fountain of Youth Academy of Cosmetology to retain any Title IV credit balance on my account to be applied toward future allowable charges incurred during the academic year. I understand that I may refuse this authorization or cancel it at any time by submitting a written request to the Financial Aid Office. If I cancel this authorization, any remaining credit balance will be paid to me, or to my parent in the case of a PLUS loan. I understand that any credit balance remaining after the end of the academic year, or after I withdraw or graduate, will be paid to me.
